1. Introduction

If you do not agree with any part of these Terms, do not use the Platform. These Terms apply together with our Privacy Policy, Refund Policy, and Content & Conduct Policy.

2. The Platform & Services

What We Do

• Motion lets creators, coaches, consultants, communities, and businesses monetize their time and expertise through paid private video calls, group calls, live streams, webinars, classes, workshops, and other ticketed live events.
• Hosts set a ticket price and share a Motion link. Participants pay before they join; only paying users receive access. Hosts earn revenue from ticket sales.
• Guests may join from a web browser or the Motion mobile apps. Hosts may go live from phone or computer, including via supported streaming software where available.

Payments & Payouts

• Attendee payments: Participants may pay in Naira (via supported payment providers) or in supported stablecoins (e.g., USDT, USDC), depending on how the host priced the event.
• Naira payouts: Hosts may withdraw earnings to a Nigerian bank account. Identity verification (KYC) is required above our unverified withdrawal limits and for ongoing Naira payouts. Verification may include documents such as a national ID, passport, driver's license, voter's card, NIN, and/or BVN, plus bank account details.
• Crypto payouts: Hosts may withdraw earnings to a valid USDT/USDC wallet address on supported networks. Identity verification is required above unverified withdrawal limits.

Platform Fees

There are no setup, hosting, or monthly subscription fees to use Motion. We earn when you earn:

• Creator share: Hosts keep 96% of the base ticket price (a 4% platform fee is deducted from the ticket amount).
• Viewer service charge: Attendees typically pay an additional service charge (currently 10% of the base ticket price) on top of the ticket price. Payment-processor fees may also apply depending on the payment method.
• Withdrawal fee: A fee of 1.5% of the requested withdrawal amount applies to payouts. Network/gas fees for crypto transfers are the user's responsibility.

Fee amounts may change; current examples are described on our How It Works page. Continued use after a fee change constitutes acceptance of the updated fees.

3. Eligibility & Account Registration

• Attendees (buy & join): You must be at least 13 years of age to create an account, buy tickets, or join sessions. If you are under 18, you represent and warrant that you have your parent's or legal guardian's permission to do so. Buying a ticket does not require identity verification (KYC).
• Hosts (create & sell): You must be at least 18 years of age to host paid sessions, sell tickets, receive earnings, or request withdrawals. By creating a paid session or enabling payouts, you represent that you are 18 or older.
• Account Creation: You must provide a valid email address and authenticate through our supported sign-in methods. Additional profile, identity, and payout information may be required if you wish to host paid sessions or withdraw earnings.
• Account Security: You are responsible for safeguarding your login credentials and must promptly notify [email protected] of any unauthorized use of your account.
• Verification: Withdrawing earnings above unverified limits, and receiving ongoing Naira bank payouts, requires completing identity verification. Providing false or incomplete verification information may result in withheld payouts or account suspension.

4. User Responsibilities

• Provide accurate, complete, and up-to-date information during registration, verification, and payout setup.
• Comply with all applicable laws, regulations, and third-party rights.
• Do not engage in fraud, harassment, hate speech, or activities that violate the law, these Terms, or our Content & Conduct Policy.
• Do not attempt to circumvent our fees, paywalls, access controls, or other technical measures.
• Take responsibility for content you create, broadcast, or share via the Platform, and for delivering the paid session you advertise.
• Hosts are responsible for setting clear expectations (time, format, and content) for ticketed calls and streams.

5. Payments & Earnings

• Payment processing: Payments are processed by third-party providers. Motion does not store full card numbers or CVV data.
• Access: Purchase of a ticket grants access to the corresponding paid session or stream subject to these Terms and any host-stated rules. Tickets are generally non-transferable except as we expressly allow.
• Earnings availability: Host earnings typically become available for withdrawal after a session ends, subject to processing times, holds for risk/fraud review, and verification requirements. Most withdrawals are processed within about 24 hours, but timing is not guaranteed.
• Currency & crypto: Users acknowledge and accept the inherent risks of crypto transactions, including value fluctuations, network congestion, and irreversible transfers to incorrect addresses.
• Taxes: Users are responsible for determining and fulfilling any tax obligations related to earnings or purchases.
• Refunds: Refund eligibility is governed by our Refund Policy.

6. Intellectual Property

• Platform IP: All logos, trademarks (including Motion and use.live), software, and design elements are owned by or licensed to United Castles Limited.
• User IP: You retain ownership of your content but grant us a worldwide, non-exclusive, royalty-free license to host, display, transmit, and distribute it as needed to operate and promote the Platform.
• Sharing & recording: Users may only share, record, or redistribute another user's content with explicit permission from the content owner, except where the Platform itself provides recording or replay features you are authorized to use.

7. Limitation of Liability

• The Platform is provided "as is" without warranties of any kind, including uninterrupted or error-free service.
• We do not endorse or guarantee the accuracy, quality, or outcomes of sessions hosted by users. Disputes between hosts and attendees should first be directed to support; our involvement is at our discretion.
• To the maximum extent permitted by law, our liability is limited to fees we received from you in the six months preceding any claim.
• You agree to indemnify us against claims arising from your content, your sessions, or your use of the Platform in violation of these Terms.

8. Changes to Terms

We may update these Terms periodically. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We will notify users of significant changes via email or Platform notifications when practicable.
